O R D E R

The Civil Revision Petition has been filed seeking a direction to the VI Additional District Court, Madurai District to dispose the petition in O.S.No.92 of 2015 within a period stipulated by this Court.

2.The learned counsel for the petitioners would submit that the petitioners are the defendants in O.S.No.92 of 2015. The respondent/ plaintiff has filed a suit seeking for a declaration and permanent injunction, based on an unregistered Will. The petitioners/defendants have filed their written statement and issues were framed on 27.10.2015 itself and though the suit is ripe for trial from the year 2016, there is no progress in the case. 3.Heard the learned counsel for the petitioners and perused the materials available on record.

4.Considering the limited prayer sought for in the Revision, notice to other side is deemed unnecessary. 5.From the 'B' Diary extract produced by the petitioners, it is seen that the suit is being adjourned for trial from 06.01.2016, for more than five years.

6. Considering the fact that the suit is pending for the past five years without any progress, this Court is inclined to pass the following order:

C.R.P.(MD) No.1551 of 2021 "The VI Additional District Court, Madurai District, is directed to dispose of O.S.No.92 of 2015, pending on his file, on merits and in accordance with law, as expeditiously as possible, preferably, within a period of six months from the date of receipt of copy of this order."

7. With the above direction, the Civil Revision Petition stands disposed of. No costs.
