ORDER

The petitioner has approached this Court to quash the FIR in Crime No.96 of 2024 pending against him on the file of the respondent police.

2.The learned Counsel for the petitioner submits that the case has been registered as against the petitioner that two motorcycles of the defacto complainant were set to fire. The petitioner has not committed any offence. However based on the statement made by one Neelakandan, the case has been registered against the petitioner. The learned Counsel further submits that the said Neelakandan has confessed to the petitioner that he has not reported to the police. 3.The learned Government Advocate (Crl Side) appearing for the respondent police submits that two motorcycles of the defacto 2/5

complainant were set to fire in his house in the midnight. The investigation agency has collected certain photographs. He further submits that one Neelakandan has noticed the incident and also reported to the Fire Service Department. The investigation is in crucial stage.

4.This Court has considered the rival submissions made. 5.The investigation is a process of finding truth. According to the learned Government Advocate, the occurrence has taken place in the late night and therefore, they are finding it difficult to trace the real accused. However Fire Service Personnel has been informed by one Neelakandan and he has also informed that the petitioner has set fire to the motorcycles. Therefore this Court is not inclined to entertain the petition on the grounds raised by the petitioner. The respondent police shall conclude the investigation within a period of eight weeks from the date of receipt of a copy of this order. The respondent police shall find out the real 3/5

accused and the grounds raised by the petitioner shall be considered by the investigation agency. If any final report is filed as against the petitioner, it is always open to the petitioner to challenge the final report in the manner known to law. Accordingly, this petition is dismissed.
