PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the third respondent to pay the EPF amount accrued into the credit of the petitioner together with interest within a period stipulated by this Court, by considering the representation dated 02.01.2018. ORDER
This Writ Petition is filed to direct the 3rd respondent to pay the EPF amount payable to the petitioner together with interest. 2.It is the grievance of the petitioner that with the relief sought for in the prayer, though he has made a representation, dated 02.01.2018 to the 2nd respondent, no action has been taken so far. Hence, the petitioner is before this Court seeking appropriate orders.
3.None appeared on behalf of the respondents. 4.On a perusal of the representation, dated 02.01.2018, this Court is of the view that there is no legal impediment for the respondents to consider the petitioner's representation, dated 02.01.2018 and to dispose of the same and accordingly, this Court is inclined to pass the following direction:- https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD) No.19023 of 2020 the 3rd respondent is directed to consider the petitioner's representation, dated 02.01.2018 and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order and as per the entitlement, disburse the EPF amount payable to the petitioner, if any, along with interest, within a period of six weeks therefrom; 5.With the above direction, the Writ Petition stands disposed of. No costs.
