ORDER

The petitioners/A2 to A-4, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 120B, 406, 417, 420, 468, 471 & 294(b) of IPC, in Crime No. 10 of 2025, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that it is a case of job racketing. The accused persons have issued bogus appointment order and collected more than Rs.55,00,000/-from several persons. Hence, a case has been registered.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocents persons and they did not commit any offence as alleged by the prosecution.

4. The learned Government Advocate (Crl.side) appearing for the respondent Police submitted that A-2 was arrested and he strongly objected to grant anticipatory bail to the petitioners. 2/6

5. Since A-2 was arrested this Criminal Original Petition stands dismissed against him.

Considering the facts of the case the petitioners/A-3 & A-4 are directed to deposit Rs.1 Lakh, each, in Crime number within a period of four weeks from the date of receipt of a copy of the order, before the learned Judicial Magistrate, Theni and thereafter the same shall be deposited in the interest accruing deposit in any one of the Nationalised bank. On such deposit, this Court is inclined to grant anticipatory bail to the petitioners-2 & 3 /A3 & A4.

Accordingly, this criminal original petition is partly allowed and the petitioners 2 & 3 are ordered to be released on bail in the event of arrest or on their appearance, before the learned Judicial Magistrate Court, Theni, on condition that the petitioners 2 & 3 shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate Court, Theni and on further conditions that: 3/6

(a) the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; (b) the petitioners shall furnish their residential address and mobile number to the learned Judicial Magistrate, Theni. In the event of any change in his residential address, the petitioners shall report the same to the learned Judicial Magistrate, Theni;

(c) the petitioners shall stay at Tiruppur and appear and sign before the Tiruppur Town Police Station at 10.30 a.m.., for a period of two weeks and thereafter shall appear before the respondent police as on when required for investigation;

(d) the petitioners shall not tamper with evidence or witness either during investigation or trial;

(e) the petitioners shall not abscond either during investigation or trial;

(f) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court 4/6

himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560] and;

(g) if the accused/petitioners thereafter abscond, a fresh FIR can be registered under Section 269 of BNS, 2023.
