ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents to sub divide and issue separate patta in favour of the petitioner in respect of Survey No.36/6A9, measuring an extent of 28 cents out of 90 cents, situated at Arunachalapuram Village, Aranthangi Taluk, Pudukkottai District, on the basis of petitioner's application No. 2026/0105/22/012797 dated 09.05.2026.
2. The learned Counsel for the petitioner submitted that the total extent of the property is 78 cents, however, the petitioner has inadvertently stated as 90 cents in the prayer portion. The said statement is recorded.
3. The petitioner is claiming right over the property in Survey No.36/6A9, measuring an extent of 28 cents, out of 78 cents, based on the sale deed vide Document No. 217 of 1988 dated 22.04.1988. The said property was purchased by the petitioner's father, namely, Kalimuthu, from one Aapu Thevar. After the demise of the petitioner's father, the petitioner, being the sole legal heir has inherited the property. Originally, the said Aapu Thevar was having joined patta. After his lifetime, the legal heirs, namely Somaiah Thevar, Muthu Thevar, Amabalavana Thevar and Ganesha Thevar had inherited the property based on 2/5
succession. Subsequently, they entered into a partition. The portion allotted to the said Amabalavana Thevar, was sold to the petitioner's father. Based on the above facts, the petitioner is seeking to survey the subject property. The petitioner has also submitted an online application seeking issuance of separate patta. However, in the prayer, the petitioner has additionally sought a direction for subdivision of the property.
4. In view of the above, the petitioner is directed to submit a separate online application to survey the subject property. On such application, the respondent shall conduct a survey after issuing notice to the petitioner and the rival claimants, if any, within a period of twelve weeks from the date of receipt of a copy of this order. If the respondent requires police protection, the same shall be provided by the jurisdictional police. Based on the survey report, the respondent shall consider the petitioner's request for issuance of a separate patta and pass appropriate orders in accordance with law, within a period of twelve weeks therefrom. The official respondents shall adhere to the following Standard Operating Procedures: • The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. 3/5
• After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.
• If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties.
5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
