2. Heard both sides.
3. The grievance of the petitioner is that seeking police protection to conduct the Adal Padal Dance Programme on 03.09.2019 in the above said temple, the petitioner made a representation on 09.08.2019 to the respondents and the said representation was not considered so far. Hence, the present Writ Petition has been filed for the aforesaid relief.
4. Today when the matter is taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the respondents, on instructions, would submit that already the petitioner's application has been considered and permission sought by the petitioner was rejected on the ground that the Viniayagar Chathurthi is being celebrated on 02.09.2019 and the permission cannot be granted to conduct the festival on 03.09.2019. Now the respondent police is willing to consider the request of the petitioner to conduct the Vinayagar Chathurthi festival on 03.09.2019.
5. Considering the facts and circumstances of the case, since the respondent police is willing to consider the request of the petitioner to conduct the festival, the petitioner is directed to made a fresh representation to the second respondent. On receipt of the same, the second respondent is directed to consider the same and grant permission to the petitioner to conduct the festival by imposing necessary conditions to maintain the law and order problem.
6. With the above direction, this Writ Petition is disposed of. No costs.
