ORDER
The petitioner was appointed as the Secondary Grade Teacher in the third respondent school on 04.06.2019. Accordingly, the third respondent submitted a proposal for approval of the appointment of the petitioner to the first respondent. The first respondent, having considered the said proposal, finally, through the proceedings in Na.Ka. No. 304/A3/2026 dated 20.02.2026 granted approval for the appointment of the petitioner with effect from 04.06.2019, that is, the initial date of appointment, subject to certain conditions. One of such conditions is that the petitioner has to produce Genuinity Certificate with reference to the Certificates that are submitted along with the proposal for approval. However, as the salary for the services rendered by the petitioner from 04.06.2019 has not been disbursed, the petitioner claimed to have submitted a representation dated 16.05.2026 before the respondents 1 2/5
and 2. As the respondents 1 and 2 have not taken any action on the said representation, the petitioner has approached this Court by filing the present writ petition.
2.Mr.M.Dinesh Hari Sudarsan, learned Counsel for Government appearing for the respondents 1 and 2, on instructions, submitted that the petitioner is under obligation to comply with the conditions mentioned in the proceedings dated 20.02.2026 and it is only on compliance with the said conditions, the petitioner will be released with all the salaries.
3. In response to the same, the learned counsel appearing for the petitioner submitted that the petitioner would take all necessary steps to comply with the said conditions and then, approach the respondents 1 and 2 for release of salary.
4. In the light of the above, this writ petition is disposed of permitting the petitioner to comply with the conditions mentioned in proceedings dated 20.02.2026 and after complying with the said conditions, the petitioner is granted liberty to approach the respondents 1 3/5
and 2 by submitting a representation for release of salary. If any representation is received or not, once the petitioner complies with the conditions mentioned in the proceedings dated 20.02.2026, the respondents 1 and 2 are under obligation to release the salary and other monetary benefits that would be payable to the petitioner in terms of the proceedings dated 20.02.2026, as expeditiously as possible, at any rate, within a period of six weeks from the date on which the petitioner complies with the conditions. No costs.
