Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.S.SIVAKUMAR, Advocate for the petitioner and of Mr.P.KOTTAI CHAMY, Government Advocate(crl.side) on behalf of the Respondent, the court made the following order:- This petition has been filed seeking extension of time to comply with the conditions imposed on the petitioner by this Court on 03.02.2021, in Crl.O.P.(MD)No.1399 of 2021, while granting anticipatory bail.

2. The learned counsel for the petitioner submits that the petitioner was suffering from jaundice and since he was in continuous treatment, he could not go to work and mobilize money for executing the bond. Moreover, since the petitioner's father was also not well and he was bedridden, the hard earned money was spent for his father treatment. Therefore, the petitioner could not execute the bond, arrange sureties and surrender before the concerned Court in time. Hence, he prayed for extension of time to comply with the conditions imposed by this Court.

3. Heard the learned Government Advocate (Crl. Side).

4. Originally, the petitioner was granted anticipatory bail on 03.02.2021. Thereafter, he did not surrender before the concerned Court. Now, this petition has been filed stating that since the petitioner was in continuous treatment for jaundice and his father https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD) No.8408 of 2021 was also bedridden, the petitioner could not execute the bond and arrange the sureties.

5. It is seen that the petitioner was granted anticipatory bail on 03.02.2021. But, the petitioner, after the lapse of seven months, has filed this petition for extension of time. In view of the inordinate delay in filing the petition for extension of time, this Court is not inclined to entertain this petition. Accordingly, the Criminal Miscellaneous Petition is dismissed. sd/- 26/10/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.) Madurai Bench of Madras High Court, Madurai - 625 023.
