ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 26.07.2024 for the offences punishable under Sections 296(b), 109(1), 118(1) and 351(3) of BNS Act, 2023 in crime No.237 of 2024 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that when the defacto complainant was driving his two wheeler, the petitioner along with the other accused came in opposite direction and dashed against the defacto complainant's bike. Further, they abused the defacto complainant in filthy language stating that where is money and attacked him with their legs and wooden log. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is innocents and he has not committed any offence as mentioned in the FIR. He would further submit that the petitioner is in judicial custody from 26.07.2024 and hence, he may be granted bail.
4.The learned Additional Public Prosecutor would submit that the injured is still in hospital and the investigation is in initial stage. Hence, he vehemently, opposed to grant bail to the petitioner.
5.Considering the facts and circumstances of the case and also considering the fact that the injured is still in hospital, this Court is not inclined to grant bail to the petitioner.
