ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus to quash the Impugned Refusal Order of the 2nd respondent dated 29.03.2025 and consequently direct the respondent to register the Sale deed within the time stipulated by this Court.

2. The 2nd respondent has stated in the impugned order that an objection had already been submitted by one Pappathi, who claimed that a document had been registered in her name. Furthermore, she had executed a sale deed in favour of another person, which was also registered in respect of the same survey number. Therefore, registering another document would amount to a double entry.

3. This Court is of the considered opinion by citing double entry the 2nd respondent cannot refuse to register the document. Therefore, the refusal order dated 29.03.2025 is hereby quashed. The 2nd respondent is directed to register the sale deed within a period of four weeks from the date of receipt of a copy of this order. It is made clear that the 2nd respondent shall register the document with remark as double entry.

4. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
