O R D E R

The present Writ Petition has been filed for the issuance of a Writ of Mandamus directing the respondents to survey and demarcate the land comprised in Survey No.81/2A1A, Kizhagudi Village, Madurai West Taluk, Madurai District, measuring an extent of 12 cents, by disposing of the petitioner's application in Manu No.2026/0123/24/003720 dated 09.05.2026.

The petitioner's father, namely, Paraman, had purchased the property in Survey No.81/2, measuring an extent of 12 cents, through the Sale Deed dated 01.07.1980 registered as Document No.3334 of 1980. Thereafter, the petitioner's father was in possession and enjoyment of the said property. The patta was issued in the name of the petitioner's father as a joint patta. The petitioner's father died on 06.09.2011. Page No. 2 of 6

3. After the demise of the petitioner's father, the petitioner, along with his mother and siblings, namely, Mahadevi, Sekar, Santhi, Kannan, Karthikaiselvi and Pappa, are entitled to the property. The joint patta in Patta No.1089 also stands in the names of the petitioner, his mother, his siblings and others.

4. The fourth respondent has trespassed into the petitioner's property and is disputing the petitioner's possession. The fourth respondent has also submitted an application for an electricity connection, pursuant to which the second respondent has erected an electricity pole in the petitioner's land.

5. Therefore, the petitioner intends to survey the land and the demarcate the boundaries. Accordingly, the petitioner submitted an application along with the requisite fee.

Therefore, the first respondent/Tahsildar is directed to consider the petitioner's application and survey the property after issuing notice to the petitioner, the petitioner's mother and siblings, the second respondent, the fourth respondent and the rival claimants/objectors, if any, in Page No. 3 of 6

accordance with law. In case the first respondent/Tahsildar is seeking police protection for carrying out the survey, the third respondent police shall provide the necessary police protection. The first respondent shall adhere to the following Standard Operating Procedures: • The first respondent shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

• After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. • If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest.

The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order.
