Respondent(s) For Petitioner(s): Mr.K.Anandan For Respondents 1 to 8 : Mr.M.S.Parthiban, Counsel for State Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, call for the records pertaining to the mutation of patta bearing Patta Nos.2375, 2326, 2270, 2279, 2391, 2348, 2303, 2515, 2377, and 2361, in the names of Respondents 9-13 respectively for the lands originally assigned to landless poor in Mallanampatti Village, Nilakottai Taluk, Dindigul District, and quash the same as illegal, null and void and consequently directing the Respondent Nos.1 to 5 to forthwith take all necessary steps for the immediate removal of the encroachments made by the private solar companies, on the Government land bearing Survey No.1, situated at Mallanampatti Village, Nilakottai Taluk, Dindigul District, classified as Seela Karadu and assigned lands in survey Nos. 2/1,2/3,17/5 to 17/8, 135/2,135/5, 279/1, 310/1,310/3, 22/2, 22/3, 22/8,19/3,19/5, 290/2,290/4,116, 283/2,

135/4, 19/4, 18/1 to 18/4, 8/1, 8/4, 113/10, 113/11, 113/4 to 113/9 and 119 assigned between the years 2006 to 2011 and to restore the land to its original status. Further directing the Respondent Nos. 1 to 5 to initiate a high-level inquiry against the revenue officials involved in furnishing false information, manipulating records, and facilitating the illegal mutation and encroachment of Government land and the financial fraud involving the mortgaging to various banks for loans worth approximately Rs. 150 crores and to take appropriate disciplinary and criminal action against all erring officials and individuals as per law.

ORDER

(Order of the Court was made by the Hon'ble N.Sathish Kumar J.) The petitioner is challenging the assignment said to have been given in the year 2006. The petitioner claims to be a farmer challenges various assignment given to various third parties. According to him, contrary to the assignment conditions, the assigned lands were sold and now the private respondents are in possession of the assigned lands.

2. It is the contention of the petitioner that as per the assignment order, the assigned lands could not be sold for 30 years. When this Court posed a question to the learned counsel for the petitioner to produce any of the assignment order, learned counsel was not in a position to produce the same.

3. We are of the view that such contention is without any basis. Normally, upto a maximum of 10 years restriction will be imposed in every assignment for sale of the assigned lands. Putting 30 years condition for sale of assigned land itself is introduced for the first time. To substantiate the said contention, no document has been produced. Hence, we are of the view that this Public Interest Litigation is filed with some other motive. Thus, we do not find any merits in this writ petition.

4. Accordingly, the Writ Petition stands dismissed. No costs. Consequently, connected

miscellaneous petitions are closed.
