ORDER

This writ petition is filed for a Mandamus directing the respondents to conduct survey, earmark the four boundaries and issue separate patta for the petitioner's land in S.No.167/1C, to an extent of 2180 Sq. ft. situated at Seplapatti, South Medu, Kulithalai Taluk, Karur District.

The case of the petitioner is that he had purchased the property under a registered sale deed dated 25.02.2015 vide sale deed No.189 of 2015 on the file of the Registrar Office, Nangavaram, Karur District. Thereafter, he made an application to the first respondent seeking mutation of revenue records and separate patta. However, the same did not evoke any response. Thereafter, the petitioner made several remainders to the respondents 1 and 2 in this regard, pursuant to which the second respondent had directed the first respondent to survey the petitioner's land. However, the first respondent has not taken any steps to date. Hence, the petitioner is before this Court. 2/5

3. Heard the learned counsel on either side.

Considering the request of the petitioner and also the fact that the petitioner has made her representations as early as in 2020 and 2021, a mandamus is issued to the respondents to conduct survey and earmark the four boundary of the petitioner's land. The petitioner shall submit all the relevant records to show his title to the property and the respondents shall, after issuing notice to the adjacent land owners and interested parties, hold an enquiry and thereafter proceed to pass orders either surveying or earmarking the four boundaries of the property or rejecting the request. In the case of a rejection, a speaking order shall be passed. After the survey and demarcation, the petitioner shall be issued with the patta. The aforesaid exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.
