ORDER

Seeking to forbear the respondents 4 to 7 and 9 & 10 from harassing the petitioner to hand over her precious stones kept in the 8th responded bank, this writ petition is filed.

2. The learned counsel for the petitioner submitted that earlier false NDPS case was registered as against the petitioner's husband. Pursuant to which the petitioner frequented to the jewellery shop for the purpose of selling the precious stones which she had inherited from her ancestors. The jewellery shop owner had intimated the same to the respondent police. Thereafter, the respondent police had been continuously harassing the petitioner to hand over those precious stones to them. Since the petitioner did not yield to the compulsion of the respondent police, the respondent police had framed the false NDPS case against the petitioner's husband and had remanded him to judicial custody. Even thereafter, the trouble by the respondent police more particularly, respondents 4, 7, 9 and 10 is continuing and hence, this writ petition.

3. The learned Government Advocate(Crl.side) submitted that no such harassment has been caused by the respondent police.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

5. Unless and until any proper evidence or complaint has been received 3/6

as against the petitioner with respect to the possession of any precious stones illegally, the respondent police shall in no manner interfere with the possession of the same and should not require the petitioner to produce the same before them.
