Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the first respondent to dispose the appeal filed by the petitioner on 04.11.2024 against the recovery order passed by the third respondent in Na.Ka.No. 2609/tho.u/2022 dated 26.06.2024 within the time fixed by this Court. 1/4

ORDER

The instant writ petition has been filed seeking a direction to the first respondent to dispose the appeal filed by the petitioner dated 04.11.2024 within the time stipulated by this Court. 2.The learned counsel for the petitioner submits that the appeal filed by the petitioner as against the order of recovery passed by the third respondent on 04.11.2024, is still pending without any consideration and the same shall be directed to be disposed.

3.Considering the limited scope of the relief sought for by the petitioner, there shall be a direction to the first respondent to dispose of the petitioner's appeal dated 04.11.2024 on its own merits and pass appropriate orders in accordance with law, after affording an opportunity to the petitioner, within a period of twelve weeks from the date of receipt 2/4

of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.

4. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs.
