This petition has been filed seeking direction to the second respondent not to harass the petitioner under the guise of enquiry on the basis of the complaint given by the third respondent herein.

The learned counsel for the petitioner would submit that there was a money dispute between the petitioner and the third respondent herein and he received a sum of Rs.2,00,000/- and later paid Rs.1,00,000/- and the remaining balance Rs.1,00,000/- has to be paid and hence, the third respondent has given a complaint based upon which CSR No.716 of 2021 has been assigned and the second respondent is harassing the petitioner to settle the amount.
3. The learned Additional Public Prosecutor would submit that the third respondent has given a complaint against the petitioner https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.15351 of 2021 stating that he received Rs.3,00,000/- assuring to secure a job in Education Department and later he failed either to repay the amount or secure a job on the basis enquiry is underway. He would further submit that both of them did not appear.
4. Let a copy of the complaint be received by the learned counsel for the petitioner. Since the complaint has been given with regard to cheating, the petitioner has to appear before the second respondent herein, and to cooperate with him to complete the enquiry. The question of harassment may not arise. If any trouble arises in future, the petitioner is at liberty to initiate appropriate proceedings. I find no merit in this petition. Accordingly, this petition deserves dismissal and the same is dismissed with the above said liberty.
