For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory Bail in Crime No.59 of 2013 on the file of the Respondent Police.

ORDER : The Court Made the following order :- The petitioner is the sole accused in C.C.No.265 of 2014, on the file of the learned Judicial Magistrate, Thiruppathur. Non Bailable Warrant has been pending against the petitioner for the last four years. The petitioner did not take regular bail during investigation stage nor he appear before the Court. The petitioner has been responsible for keeping the proceedings pending for over five years. The conduct of the petitioner cannot be condoned. But then, the petitioner's counsel states that he would appear on every hearing date and cooperate for speedy disposal of the case. Since such an undertaking has been given, I am inclined to take an indulgent view. The next hearing date is 30.09.2019.

The petitioner shall appear before the learned Trial Magistrate and surrender and apply for recall of the warrant. On such application is being filed, the learned Trial Magistrate shall recall the warrant at the end of the day. The petitioner shall however not be remanded. This indulgence is shown since the petitioner has given an undertaking that he will appear on every hearing date and will not abscond.
