Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the 2nd respondent herein to settle the pending remaining amount of Rs.1,15,87,000/- for seed storage godowns at Needamangam, Valangaiman, Kanjikudikadu, Thiruvarur District, and Thirukadaiyur, Nagamangam, in Nagapattinam District with the assistance from Sub-Mission for Seed and Planting Material (SMSP) 2019-20 and construction of seed processing unit Godown Kanjikudikadu, in Thiruvarur District with the assistance from Sub-Mission for Seed and Planting Material (SMSP) 2019-20 with an Agreement value of Rs.24,07,000/- with an interest of 8 percent till the payment of money.

ORDER

Heard the learned counsel on either side.

2. There is no dispute that the writ petitioner had put up the petition mentioned construction. However, he has not been paid the entire bill amount.

3. The second respondent is directed to pay the balance amount payable to the writ petitioner within a period of twelve weeks. The learned Additional Government Pleader of-course sought a longer period. This is the matter in which the petitioner had already completed his contractual obligations and therefore, in my view, grant of twelve weeks time itself is more than sufficient. If the second respondent fails to make the payment within a period of twelve weeks, the second respondent will have to pay interest at the rate of 6% per annum thereafter.

4. The Writ Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
