ORDER
(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) This petition has been filed by the petitioner seeking for a direction directing the respondents 1 and 2 to secure the detenue by name C.Pushpavalli, W/o.Chinnasamy, aged about 45 years and produce her before this Court and set her at liberty.
2. The case of the petitioner is that on 02.06.2025 the petitioner's mother had gone to Ponnamaravathy for shopping and did not return back to home and unable to trace his mother, he has given a complaint to the second respondent. Based on the complaint given by the petitioner, the respondent police has registered a case in Cr.No.63 of 2025 for 'women missing'. Later, the petitioner came to know that the third respondent had kidnapped his mother. Despite the complaint given by the petitioner, the respondent police have not taken any steps to find out the whereabouts of his mother and the third respondent, thereby, the present habeas corpus petition has been filed.
3. When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the official respondents submitted that the detenu has been secured at Coimbatore and she has been produced before this Court.
4. We enquired the alleged missing person and she stated that due to harassment by her husband, she went to Coimbatore and was staying with her relative and she expressed her unwillingness to go along with her husband/petitioner.
5. Recording the submission of the detenue and finding that she is not under illegal detention, this habeas corpus petition is closed. [A.D.J.C., J.] & [R.P., J.] 08.07.2025 NCC:Yes/No Index:Yes/No am
