Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to settle a sum of Rs.18,450/- towards the payment of Post Retirement Benefits Scheme amount, together with interest at the rate of 6 % p.a. payable to the petitioner from the date of his retirement i.e. 31.12.2018 to till the date of payment and all other attendant benefits to him within the stipulated period. ORDER

By consent of both the parties, this Writ Petition is taken up for final disposal.

2. The limited prayer sought for in the present Writ Petition is for disbursal of sum of Rs.18,450/- towards Post Retirement Benefits Scheme as well as for interest on the belated payment of the benefits.

3. When the petitioner herein had made an application under the Right to Information Act for details of his entitlement for the Post Retirement Benefits Scheme, the respondents herein, through an order dated 17.07.2022, had replied stating that the petitioner is entitled for a sum of Rs.18,500/-. Admittedly, the aforesaid sum has not been paid to the petitioner at the time of his retirement on 31.12.2018.

In the light of the information supplied by the respondents herein, there shall be a direction to the respondents to consider the petitioner's representation, dated 03.07.2022, within a period of eight (8) weeks from the date of receipt of a copy of this order and disburse the said amount of Rs.18,500/- together with interest at the rate of 6% from the date on which the amount is due to the petitioner herein.

5. With the above direction, the Writ Petition stands disposed of. There shall be no order as to costs.
