PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, directing the second respondent Police not to harass the petitioner and his family under the guise of enquiry..

For Petitioner : Mr.A.S.Vaigunth For Respondents : Mr.B.Thanga Aravindh Government Advocate (Criminal Side) O RDER This Criminal Original Petition is filed seeking for a direction to respondent Police not to harass the petitioner under the guise of an enquiry on a complaint given by one Rajkumar. 1/4

2. It is submitted by learned counsel for the petitioner that the engagement with the petitioner's daughter and the said Rajkumar was settled and engagement was also performed. Subsequently, on account of attitude of the said Rajkumar, the marriage proposal between the petitioner's daughter and the said Rajkumar was cancelled. Since then, respondent No.3 has been approaching the Police through whom the petitioner is being harassed.

Learned Government Advocate (Criminal Side) on the other hand submits that on a complaint given by Rajkumar, the respondent Police made an enquiry and both the petitioner and the said Rajkumar appeared before the Police and reported that they will resolve all the issues before the elders. Accordingly, the representation given by the said Rajkumar, dated 23.05.2023, was closed and subsequently, the petitioner was never called by any of the Police.

4. Learned counsel for the petitioner, however, submits that, even after closure of the said petition, still, respondent No.3 has been harassing and calling the petitioner and asking to pay a sum of Rs.4,00,000/- (Rupees Four Lakhs only) compensation to the said Rajkumar.

5. The dispute between the petitioner and the said Rajkumar is purely private, that too, in respect of that, matrimonial issue which has not not been taken place. Since both of them stated to have given undertaking that they will resolve the dispute before the elders, the respondent Police are directed not to harass the petitioner any more in this aspect.

6. Accordingly, this Criminal Original Petition stands closed.
