PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the Impugned Order in Jo.Ho.No.10948776 dated 20.03.2025 on the file of the Respondent and quash the same as illegal and consequently direct the Respondent to issue computerized Patta and Chitta in the petitioner name for her property located at Survey No.312/104 in Koduvilarpatti - Pallapatti village, Theni District and effect the entries in Tamil Nilam website as per G.O. ORDER
An order dated 13.01.2021 rejecting the petitioner's request for grant of patta is challenged in this writ petition.
2. Learned counsel for the petitioner invited by attention to the assignment order and G.O.Ms.No.34 dated 13.01.2021. He submits that the impugned order has been issued without taking into account these material documents, particularly, G.O.Ms.No.34. Therefore, he contends that the impugned order cannot be sustained.
3. Learned Special Government Pleader referred to the counter affidavit of the respondent, particularly paragraph No.6 thereof to justify the impugned order.
4. On perusal of the impugned order, it is evident that the request of the petitioner was rejected by stating that the land is classified as Government poramboku and that action would be taken after obtaining a valid order. The impugned order does not refer to the assignment order in favour of petitioner or G.O.Ms.No.34 dated 13.01.2021. In view of non consideration of material documents, the impugned order cannot be sustained. Consequently, the impugned order is set aside and the matter is remanded to the Tahsildar for 2/4
reconsideration. Such reconsideration shall be undertaken after taking note of G.O.Ms.No.34 dated 13.01.2024 and after providing a reasonable opportunity to the petitioner. A speaking order shall be issued within three months from the date of receipt of a copy of this order. No costs. Consequently, connected writ miscellaneous petitions are also closed.
