by setting aside the order dated 20.06.2025.
ORDER : The Court Made the following order :- This petition has been filed to restore the Criminal Miscellaneous petition in Crl.M.P.(MD).No.7649 of 2025 on the file of this Hon'ble Court which was dismissed for Non-prosecution by setting aside the order dated 20.06.2025.
2. The learned Counsel for the petitioner would submit that this petitioner had filed an bail petition before this Court on 28.03.2025 in Crl.OP.(MD).No.6077 of 2025. The said bail petition was heard and on 07.04.2025, this Hon'ble Court was pleased to grant bail to the petitioner with a condition to report and sign before the learned Judicial Magistrate, Theni on all working days at 05.30p.m. until further orders. This petitioner has been complied the said condition from 21.04.2025 to till now. The petitioner has filed a relaxation petition before this Court in Crl.M.P.(MD).No.7649 of 2025, praying to relax to the said condition. On 20.06.2025, the said relaxation petition was dismissed by this Hon'ble Court as dismissed for Non-Prosecution. Due to the ill health of the petitioner's Counsel, he could not attend the Court on the said date. This petitioner is a college going student and he is studying BBA at Arts and Science College, Theni. Therefore, the petitioner seeks indulgence of this court by restore the relaxation petition in Crl.M.P.(MD).No.7649 of 2025. Hence, he prays 2/4
to allow the present restoration petition.
4. The learned Government Advocate (Crl.side) appearing for the respondent has not raised any objection to allow this Criminal Miscellaneous Petition.
5. Considering the submissions made by the learned Counsel for the Petitioner and being satisfied with the reasons stated above, this Court is inclined to allow this petition.
6. Accordingly, this Criminal Miscellaneous Petition is allowed. Registry is directed to restore the Crl.M.P.(MD).No.7649 of 2025 dated 20.06.2025 and list the same on 23.07.2025.
