PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus calling for the records in respect of order passed by second respondent in Mu.Mu.No.6484/A2/2024, dated 11.06.2026 in so far as granting approval from 28.01.2026 and condition No.3 and quash the same as illegal and consequently direct the second respondent to approve the appointment of the petitioner from 03.06.2019 and disburse all the service and monetary benefits.

O R D E R

Mrs.K.Porkodi, learned counsel for the Government, takes notice for the respondents 1 to 3 and Mr.B.Azhagan, learned counsel, takes notice for the fourth respondent.

2. With the consent of both sides, this writ petition is disposed of at the admission stage.

3. Heard the learned counsel for the petitioner, learned counsel for the Government appearing for the respondents 1 to 3 and learned counsel appearing for the fourth respondent.

This writ petition has been filed challenging the proceedings bearing Mu.Mu.No.6484/A2/2024, dated 11.06.2026, issued by the second respondent, whereby approval for the appointment of the petitioner as B.T.Assistant (Tamil) in the fourth respondent - School was granted only with effect from 28.01.2026, though the petitioner is entitled for approval from the date of her actual appointment i.e., from 03.06.2019.

A perusal of the impugned proceedings would disclose that the appointment of the petitioner was refused to be approved from the date of the actual appointment of the petitioner only on the ground that the fourth respondent - School being a School run by a Corporate Management, without exhausting the surplus staff working in the other Schools, which come under the same Management, has appointed the petitioner.

Learned counsel for the petitioner submits that the very same issue has fallen for consideration before this Court in W.P.(MD) No.5789 of 2026 and etc. batch and this Court, vide order dated 08.06.2026, allowed the said writ petitions by following the Judgment passed by a learned Division Bench of this Court in W.A.(MD) No.2733 of 2025, under an identical fact situation.

Mrs.K.Porkodi, learned counsel for the Government, appearing for the respondents 1 to 3, having verified the facts of the case on hand and the order dated 08.06.2026 passed by this Court, fairly submitted that the facts of the present case are identical to the facts of the case in W.P.(MD) No. 5789 of 2026 and etc. batch.

8. In the light of the above, following the order dated 08.06.2026, passed by this Court in W.P.(MD) No.5789 of 2026 and etc. batch, the impugned proceedings herein are liable to be quashed.

9. Accordingly, the impugned proceedings dated 11.06.2026, issued by the second respondent, are hereby quashed and this writ petition is

allowed only to the extent of granting approval for the appointment of the petitioner only with effect from 28.01.2026 and consequently, the respondents 1 to 3 are directed to grant approval for the appointment of the petitioner from the date of her actual appointment i.e., from 03.06.2019 and pass necessary orders, as expeditiously as possible, at any rate, within a period of three months from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed. 19.06.2026 NCC :
