ORDER

This civil revision petition has been filed to set aside the fair and 1/5

decreetal order, dated 19.04.2023 made in I.A.No.525(a)/2019 in I.A.No. 18/2019 in O.S.No.46/2019 on the file of Additional Sub Court, Karur and allow the Civil Revision Petition.

2.Heard the learned counsel for the petitioner and the learned counsel for the respondents and perused the records.

3.The said Interlocutory Application was filed seeking impleadment of respondents 1, 3 and 4. Notice was served on the fourth respondent; however, there was no representation on behalf of the fourth respondent. The learned Legal Aid Counsel appointed by this Court appeared for the fourth respondent. She would submit that the suit in O.S. No. 46 of 2019 has already been disposed of by the trial Court on 18.07.2025. 4.The learned counsel appearing for respondents 1 to 3 submitted that they had purchased the suit schedule property on 18.01.2019 from the fourth respondent.

5.The learned counsel for the revision petitioner, however, contended that the property had already been attached and was subject to security, and 2/5

therefore, the rights claimed by respondents 1 to 3 cannot be decided in the present proceedings. It is submitted that such issues can be adjudicated only before the Execution Court.

6.In view of the submissions made and considering that the suit itself has already been disposed of, no further orders are required in the present Civil Revision Petition.

7.Accordingly, this Civil Revision Petition is closed. No costs. Consequently, connected miscellaneous petition is closed. 8.The Court places on record its appreciation for the commendable efforts of the legal aid counsel for the respondent No.4, namely, Ms.A.Aishwarya Caroline, for conducting the case diligently and providing valuable assistance to this Court. The High Court Legal Services Committee attached to this Bench shall pay a total sum of Rs.10,000/- towards remuneration to the legal aid counsel for conducting the cases, within a period of two weeks from the date of receipt of a copy of this order, without fail. 3/5

9.Registry is directed to forward a copy of this order to the Legal Aid Committee for information.
