ORDER

The petitioners/Accused Nos.1 and 2, who were arrested and remanded to judicial custody on 02.12.2024 for the offences punishable under Sections 8(c), 20(b)(ii)(C), 25 and 29(1) of NDPS Act, 1985, in Crime No.417 of 2024, on the file of the respondent police, seek bail.

2. The case of the prosecution is that on 02.12.2024, the accused persons were in illegal possession of 25 kg 562 g of ganja. Hence, this case.

3. The learned counsel for the petitioner submits that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. However, they have been arrested and they are languishing in jail from 02.12.2024. Therefore, he prays for grant of bail.

4. The learned Additional Public Prosecutor appearing for the respondent police opposed for grant of bail on the ground that the petitioners were in possession of ganja.

5.This Court is of the considered opinion that since the petitioners were in possession of ganja, Section 37 of NDPS Act is completely against the petitioners. Therefore, this criminal original petition is dismissed. 14-11-2025 Tmg To
