ORDER : The Court made the following order :- The petitioner /Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 153A of IPC in Crime No.103 of 2023, on the file of the respondent police, seek anticipatory bail. 1/4

2. The case of the prosecution is that the defacto complainant alleged to have made a complaint stating that on 01.07.2023, a public meeting was arranged by a political party. In the above said meeting, the petitioner alleged to have made defamatory and insultive speech against another political leader, upon the public speech, the present FIR has been registered.

3. The learned counsel for the petitioners would submit that he is an innocent and he has not committed any offence as alleged by the prosecution. He undertakes that he will not indulge in such activities in future.

4. The learned Government Advocate (crl.side) would submit that the earlier petition filed by the petitioner seeking anticipatory bail was dismissed as withdrawn.

5. Considering the facts and circumstances of this case and also taking note of the undertaking affidavit filed by the petitioner, this Court is inclined to grant relief to the petitioner.

6. Accordingly, this Criminal Original Petition is allowed and on such undertaking affidavit being filed, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate, Aathuoor, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall 2/4

appear before the trial Court daily at 10.30 a.m., until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7.
