For Respondent : M/s.T.Senthil Kumar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 09 of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 5(1), 6, 16 and 17 of the Protection of Children from Sexual Offences Act, 2012 and Sections 9, 10 of the Prohibition of the Child Marriage Act, 2006, in Crime No.9 of 2021 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the first accused, on the false promise of marrying the defacto complainant's daughter, committed sexual intercourse with her and thereafter, cheated her. When the same was questioned by the defacto complainant, the accused Nos.1 to 5 threatened the defacto complainant to publish the obscene photos of the victim and abused her in filthy language. Hence, the complaint.
3.The learned counsel for the petitioner submits that the petitioners are innocents, they have not committed any offence as alleged by the prosecution, but they have been falsely implicated in this case.
4. Heard the learned Additional Public Prosecutor appearing for the respondent Police.
5. It appears that this is the third application for anticipatory bail. The earlier anticipatory bail Petitions filed in Crl.OP(MD)Nos.9190 & 12385 of 2021 were dismissed as against the petitioners on 01.09.2021 and 12.07.2021. Now, this application is filed by the petitioners without referring the change of circumstances to consider the case.
6. Since there is no change of circumstance and considering the antecedents of the petitioners, this Court is not inclined to entertain this Criminal Original Petition and the same is accordingly dismissed.
