PRAYER :-For Bail in Crime No.7 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, who was arrested on 06.08.2022 for the alleged offence under Section 7 of Prevention of Corruption Act, 1988 as amended by the Prevention of Corruption (amendment) Act, 2018 in Crime No.7 of 2022, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the defacto complainant, who was working as the Inspector of Police, Sivagangai District, has demanded bribe from the defacto complainant for dropping the action in Crime No.24 of 2022. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that initially he has refused to register FIR on the ground that FIR has already been registered on the same cause at DCB, Madurai. But, The Superintendent of Police, Sivagangai, instructed him to register a case against the defacto complainant. Hence, there is no intention to obtain bribe for dropping FIR.

CRL OP(MD). No.14959 of 2022 4.The learned Additional Public Prosecutor submitted that now, antecedent being enquired with regard to previous offences committed by the petitioner.

5.The learned counsel for the petitioner would submit that now, the petitioner is aged about 59 and going to be retired within a year.

6.Considering the period of incarceration, this Court is inclined to grant bail to the petitioner with stringent conditions. 7.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Special Judge for Prevention of Anticorruption Act Cases, Sivagangai, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
