For Respondent : Mr.R.M.ANBUNITHI, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.201 of 2024 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 6(4) of Tamilnadu Scheduled Commodities (RDCS) Order, 1982 r/w Section 7(1)(a)(ii) of Essential Commodities Act, 1955, in Crime No.201 of 2024, seeks anticipatory bail. 1/3
2. The case of the prosecution is that the petitioner was found in illegal possession of 57 bags (each contains 45 Kg) or 2565 Kg of PDS rice. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. However, he would further submit that the petitioner shall abide any condition imposed by this Court. Hence, he prays for anticipatory bail.
4.The learned Additional Public Prosecutor appearing for the respondent police would submit that the rice was recovered. The investigation is still pending and the petitioner is having 16 previous cases. Hence, he vehemently, opposed to grant anticipatory bail to the petitioner.
5.Even though 2565 Kg of PDS rice was recovered in the present case, considering the fact that the petitioner has got several previous cases, I am of the view that this is not a fit case for grant of anticipatory bail. 6.Accordingly, this Criminal Original Petition stands dismissed. sd/- 05/08/2024 / TRUE COPY / /08/2024 Sub-Assistant Registrar ( C.S.
