2 W.P.(MD)NO.20007 OF 2025 Prayer: Writ petition filed under Article 226 of the Constitution of India, issuing a Writ of Mandamus, directing the official respondents to remove the thorny acacia trees and survey and earmark the exact extent of the Valaieduppu water body situated in survey No.98, Valaieduppu Village, Musiri Taluk, Tiruchirappalli District and remove the encroachments.

Heard the learned counsel appearing for the writ petitioner and the learned Government Advocates appearing for the official respondents.

2. Issuance of notice to respondents 5 to 7 is dispensed with.

3. The petitioner is a resident of Musiri Taluk. He alleges that the petition-mentioned water body has been encroached upon. He gave representation for clearing the same. The authorities have not 2/5

3 W.P.(MD)NO.20007 OF 2025 taken any action. Hence, this writ petition came to be filed.

4. When the matter was taken up for hearing, the learned Government Advocate confirmed that survey No.98 Valaiyeduppu Village has been classified as Lake.

5. It is well settled that the encroachment on water bodies is impermissible.

6. We direct respondents 2 to 4 to take effective action so that the encroachments are cleared. The entire exercise shall be completed within a period of four months from the date of receipt of a copy of this order. The respondents 2 to 4 shall put all the encroachers on notice and adhere to due process of law before taking action.

7. The petitioner's counsel states that some CSR funds have been allotted for formation of bunds for the petition-mentioned lake. The apprehension of the petitioner is that if the said funds are deployed immediately, the encroachers would be spared. 3/5

8. We therefore direct the official respondents to first complete the direction given in this order and thereafter, deploy CSR funds for strengthening the bunds of the lake. This writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
