Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondents 1 and 2 to conduct survey and fix the boundary stones of the petitioner's land in Survey No.704 situated at Jeyamangalam Village, Periyakulam Taluk, Theni

District, and thereby direct the 3rd respondent to give adequate police protection at the time of conducting survey of the land, on the basis of the petitioner's representation, dated 30.06.2025 For Petitioner :

ORDER

The petitioner herein seeks a direction to respondents 1 and 2 to conduct survey of the property situated in Survey No.704, at Jeyamangalam Village, Periyakulam Taluk, Theni District, by considering her representation, dated 30.06.2025.

2. According to the petitioner, the subject property was gifted by her husband in favour of her by a registered gift deed, dated 01.07.2024, and patta for the said property stands in the names of her husband and his mother. It is also stated that the mother and the sister of petitioner's husband executed a release deed in favour of petitioner's husband on 08.07.2021. Thereafter, the entire property was settled by him in favour of the petitioner.

The petitioner submitted an application on 13.05.2025 in Application No. 2025/0123/25/004554, seeking survey of the property. The same has not been considered. Hence, she has come before this Court.

3. Additional Government Pleader, appearing for respondents 1 and 2, would submit that the application submitted by the petitioner will be considered in accordance with law.

4. In view of the same, without expressing any opinion on the merits of the matter, respondents 1 and 2 are directed to consider the online application submitted by the petitioner, dated 13.05.2025, and pass final orders on its own merits within a period of eight weeks from the date of receipt of copy of this order, after issuing notice to petitioner, co-pattadars, neighbouring land owners, and other interested parties.

5. Accordingly, the Writ Petition stands disposed of. No costs. 07.07.2025 NCC :
