ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the refusal check slip dated 17.02.2025 and consequently, direct the respondent to register the document styled as deed of Inam settlement executed by the petitioner in favour of her daughter dated 17.02.2025.

2. Admittedly, the petitioner has purchased the property from one Karuppana Goundar, vide Document No.851/1985. The respondent has refused to register the settlement deed, citing that a release deed executed on 08.10.2018, was registered as Document No.1683 of 2018.

3. It is seen that the petitioner had purchased the land vide Document No. 851/1985 from the said Karuppana Goundar. The said fact has been admitted by the respondent. If the said Karuppana Goundar has sold the property, then the legal heirs of the Karuppana Goundar cannot claim any right over the property. But the legal heirs of Karuppana Goundar executed a release deed dated 08.10.2018. The respondent ought to have refused to register that release deed, as the executants had no title to release. Instead, the respondent refused to register the petitioner's settlement deed, which is legally unsustainable. 2/4

4. In view of the above, the impugned order is quashed. The respondent is directed to register the petition mentioned document, within a period of four (4) weeks from the date of receipt of a copy of this order.

5. With the above said directions, this Writ Petition is allowed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 08.07.2025 NCC : Yes / No Index : Yes / No Internet : Yes jbr To:
