PRAYER:Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned Pamphlet notification dated 22.06.2025 issued by the first respondent and quash the same and consequently, directing the respondents to include the name of the eligible members in the Voters List pertaining to the conduct of the election of the said Sangam within the time stipulated by this Court.

ORDER
This Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash impugned Pamphlet notification dated 22.06.2025 issued by the first respondent and consequently, direct the respondents to include the name of the eligible members in the Voters List pertaining to the conduct of the election of the said Sangam.

2.The petitioner has submitted his objection to the voter list stating that the names of the 14 deceased have been included in the voter list. According to the petitioner, only 134 members are eligible to contest the election and participate in the election. Out of 134 members, 14 person died but, their names are exhibited in the voter list.
3.The learned counsel for the respondents as well as the intervener submitted that the verification of the voter list was issued as early as on 07.01.2025. The petitioner and other persons were silent regarding the removal of the dead persons. Hence, the said plea cannot be entertained as this stage. 4.This Court is of the considered opinion that unless the dead persons names are removed, there cannot be a fair election. Therefore, the petitioner as well as the intervener shall appear before the second respondent/Tahsildar and produce the voters' list list. Thereafter, the first respondent is directed to verify the voters' list and take appropriate steps to add the eligible persons and remove the names of the dead persons. After finalizing the voters' list, the second respondent is directed to conduct election within a period of two months thereafter.
