Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certiorarified Mandamus to call for the records relating to the order passed in O.A.1239 of 2012 dated 6.11.2012 by the third respondent and quash the same and consequently directing the respondents to sanction pension and to pay the arrears of pension payable to the petitioner taking in to account the entire period of his service from 12.7.1971 to 31.12.2005 (ie. 34 years 5 months and 19 days).
ORDER: This Writ Miscellaneous Petition is coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mrs.I.Victoria Gowri, Advocate for the Petitioner and no appearance of the respondent either in person or through advocate, this Court made the following order:
(Order of this Court was made by T.S.SIVAGNANAM, J.) We heard Mrs.L.Victoria Gowri, learned Central Government Standing Counsel for the petitioners/Postal Department. 2.This petition has been filed seeking for extension of time for compliance with the order and directions issued in W.P(MD). No.16687 of 2012, dated 10.08.2017. The petition for extension of time was filed on 14.02.2018 and notice was ordered to the respondent/writ petitioner on 23.02.2018. After which, the matter came up before this Court on 13.03.2018 by directing the petitioners to report compliance on or before 06.04.2018. Thereafter, the matter has been listed on 09.04.2018 and subsequently, on 17.04.2018, on the said date, it was represented by the learned Central Government Standing Counsel that as against the order passed by the Division Bench dated 14.03.
2017, the Postal Department has filed Special Leave Petition(SLP) before the Hon'ble Supreme Court. It is reported before this Court by the learned Central Government Standing Counsel that the Special Leave Petition was dismissed. Thereafter, the petitioners/Department have immediately taken steps and the writ petitioner has received the pension from the respondents/petitioners and the same has been processed and it is in the final stage of approval and prays for reasonable time to enable the petitioners to comply with the order in its letter and spirit.
3.Taking note of the above submissions, the petitioners/respondents are directed to comply with the order and directions issued in the writ petition in its letter and spirit on or before 04.11.2019.
