ORDER
This Criminal Original Petition has been filed to direct the respondents 1 and 2 to withdraw the investigation in Crime No.86 of 2022 pending on the file of the third respondent police and to transfer the same to any other competent investigation officer for fair investigation. 2.The learned counsel for the petitioner would submit that the petitioner's daughter had committed suicide in view of the harassment made by the accused person. Initially, the third respondent police registered a case in Crime No.86 of 2022 for the offence under Section 174 of Cr.P.C. However, the investigation was not conducted in a proper manner. Hence, the present petition is filed with the above said prayer.
3.The learned Additional Public Prosecutor appearing for the respondents would submit that for non-registration of the criminal case as against the offender, the present petition is filed by the petitioner, however, the case was registered for the offence under Section 305 of IPC against the offender. Subsequently, the offender was arrested and thereafter, he was enlarged on bail. He would further submit that the investigation has been completed and the 2/4
charge is made ready and the charge sheet will be filed before the concerned Court within a stipulated time fixed by this Court. 4.In view of the above, this Criminal Original Petition is disposed of with a direction to the third respondent police to file a charge sheet before the concerned Court within a period of 6 weeks from the date of receipt of a copy of this order.
