Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 4 herein to disburse 50 percentage of the salary of the 5th respondent to the petitioners and aged parents of 5th respondent herein and consequently direct the respondents 1 to 4 herein to withhold the provident fund, gratuity and retirement benefits till the marriage of the 1st minor daughter of the 5th respondent herein and for higher education of the minor petitioners. ORDER
The present writ petition has been filed seeking a direction to the respondents 1 to 4 herein to disburse 50 percentage of the salary of the 5th respondent to the petitioners and aged parents of 5th respondent herein and consequently direct the respondents 1 to 4 herein to withhold the provident fund, gratuity and retirement benefits till the marriage of the 1st minor daughter of the 5th respondent herein and for higher education of the minor petitioners. 2/4
2.Today, when the matter was taken up for hearing before this Court, the learned counsel for the petitioners submitted that during the pendency of the writ petition the 5th respondent himself has voluntarily filed an affidavit before this Court stating that he is ready to contribute 60% of his salary and his retirement benefits to the minor petitioners and the aged parents of the 5th respondent.
3.Recording the aforesaid submission, this writ petition stands closed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
