ORDER

(Order of the Court was made by N. ANAND VENKATESH,J.) This Habeas Corpus Petition has been filed for a direction to the first and second respondents to produce the detenue, who is said to be in the illegal custody of the third respondent and to set her at liberty.

2. Heard the learned counsel on either side.

3. The case of the petitioner is that he had a love affair with the detenue and the third respondent, who is the father, has forcibly detained the detenue and a complaint given before the second respondent also did not evoke any response and it is under these circumstances, the present Habeas Corpus Petition has been filed before this Court.

4. When the matter was taken up for hearing today, the learned counsel for the State of Tamil Nadu (Criminal Side) submitted that an

enquiry was conducted in Crime No.372 of 2026 and the detenue made it clear that she wants to stay with her parents.

5. In our considered view, the detenue staying with her parents, by no stretch can be called as an illegal detention. A Habeas Corpus Petition cannot be maintained in a case of this nature.
