PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 1 and 2 to consider the petitioner's representation dated 14.09.2021 on merits and in accordance with law protecting the right to operate cable TV in the Venkateshwarapuram @ Reddiyarpatti Village, Alangulam Taluk, Tenkasi District with License Number LCO 48631 and Operator ID is TACTVD2548631 and not to give any LCO license to the 4th respondent to operate the cable in the same village within the time fixed by this Court. O R D E R

This Writ Petition has been filed for the issue of writ of mandamus directing the first and second respondents to consider the representation made by the petitioner on 14.09.2021 and to protect the rights of the petitioner to operate Cable Tv in Venkateshwarapuram @ Reddiyarpatti Village, Alangulam Taluk, Tenkasi District and not to give any LCO license to the fourth respondent to operate cable in the same Village.

2. Heard the learned counsel on either side.

3. It is brought to the notice of this Court that the fourth respondent has already been given LCO license in the year 2021 itself. This Court has also taken the view that more than one LCO license can be issued for the same area and useful reference can be made to the order passed by this Court in W.P.(MD).No.19558 of 2020 dated 09.10.2023.

4. In view of the above, both the petitioner and the fourth respondent can operate Cable Tv in the concerned area without causing any further dispute. Apart from the same, no further orders can be passed in this writ petition.
