O R D E R
[Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed challenging the impugned proceedings of the third respondent made in No.436/VuTha.2/2026, dated 28.04.2026, wherein, ordinary leave sought for 21 days by the petitioner came to be rejected.
2. Heard the learned counsel on either side.
3. The petitioner is undergoing sentence at Central Prison, Madurai. A representation was made by the petitioner seeking for 21 days on the ground that he has to make financial arrangements for making repairs in the house. The said representation came to be rejected by the third respondent through the impugned proceedings dated 28.04.2026 on the ground that there is one pending case against the convict. Aggrieved by the same, the present petition has been filed.
4. The learned counsel for the State of Tamil Nadu (Criminal Side) on instructions submitted that the petitioner has undergone sentence of
three years and nine months. He further submitted that till now, the petitioner has neither availed emergency leave nor has availed ordinary leave.
5. Taking into consideration the facts and circumstances of the case and considering the reason for which the ordinary leave has been sought for, we are inclined to interfere with the impugned proceedings of the third respondent dated 28.04.2026 and the same is hereby quashed.
6. There shall be a direction to the third respondent to grant 21 days ordinary leave to the convict subject to the condition that he will report before the fifth respondent daily at 05.00 p.m., during the entire period of ordinary leave. The sureties will be furnished by the convict before the Jail Authorities.
7. This Writ Petition (Criminal Side) is disposed of in the above terms.
