Petition filed under 11 of the Contempt of Courts Act, to punish the Contemnor/ 2nd respondent for the deliberate and willful disobedience of the order dated 01.04.2025 passed by this Court in W.P. (MD) No.8836 of 2025.

ORDER

The instant Contempt Petition has been filed alleging wilful disobedience of the order of this Court dated 01.04.2025 passed in W.P. (MD) No.8836 of 2025.

2. The petitioner had challenged the suspension order, dated 28.02.2025. By order dated 01.04.2025, this Court directed the respondents therein to consider the representation of the petitioner seeking review of the suspension order and to post him in any non-sensitive post within a period of four weeks from the date of receipt of a copy of that order. However, by the impugned order dated 06.06.2025, the said representation was rejected, leading to the filing of the present Contempt Petition.

3. The learned Additional Government Pleader would submit that this Court, by its order dated 01.04.2025, had merely directed the respondents to consider the representation of the petitioner. No positive or mandatory direction was issued. Accordingly, the respondent 2/4

considered the representation and rejected it on merits. Hence, there is no wilful disobedience of the order of this Court.

4. In view of the above submission, this Contempt Petition stands closed, with liberty to the petitioner to challenge the impugned order dated 06.06.2025 in the manner known to law.
