PRAYER : Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 1st respondent to increase the retirement age from 58 to 59 years to petitioner's service within a time frame that may be stipulated by this Court, on the basis of this Court order in W.P.(MD).Nos.7657 & 7681 of 2020 dated 28.08.2020.

O R D E R

This Writ Petition has been filed directing the first respondent to increase the retirement age of the petitioner from 58 to 59 years.

2. When the matter is taken up for hearing, learned Standing Counsel appearing for the respondents submits that this Court has https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.[MD].No.19149 of 2020 passed an order in W.P.(MD).Nos.7657 & 7681 of 2020 on 28.08.2020 that if any requirement is there, the Department shall utilise the services of deserving employee and take a decision as to upto which age, the contract period of deserving employee can be extended. Pursuant to that, an order has been passed to the effect that there are already excess employees and no other services are required.

3. In view of the above submission, nothing survives for adjudication in the present petition. However, a direction is given to the respondents to fix the age limit of the petitioner, based on the orders passed by this Court in W.P.(MD).Nos.7657 & 7681 of 2020 dated 28.08.2020.
