To condone the absence of the Petitioner in abiding the conditions past 3 weeks before the respondent police, as per order passed by this Hon'ble Court in Crl.MP. (MD).No.814 of 2023 in Crl.OP.(MD).No.17658 of 2022. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.MAREES KUMAR.E, Advocate for the petitioner and of MR.R.SURESH KUMAR, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- Petition in Crl.M.P.(MD).No.10360 of 2023 has been filed to relax the condition imposed on the petitioner in Crl.M.P.(MD).No.814 of 2023 in Crl.O.P.(MD)No.17658 1/3
of 2023 on 19.01.2023. Petition in Crl.M.P.(MD).No.10361 of 2023 has been filed to condone the absence of the petitioner in abiding the conditions past 3 weeks before the respondent as per order passed by this Court in Crl.M.P.(MD).No.814 of 2023 in Crl.O.P.(MD)No.17658 of 2023 on 19.01.2023.
2.The learned counsel for the petitioner submitted that the petitioner has been complying with the condition imposed by this court regularly except three weeks. 3.The learned Additional Public Prosecutor submitted that the petitioner has been complying with the condition regularly except last three weeks and investigation is pending.
4.Considering the nature of offence, the condition imposed by this court in Crl.M.P.(MD).No.814 of 2023 in Crl.O.P.(MD)No.17658 of 2023 on 19.01.2023 is modified and the petitioner shall report before the respondent police once in a month at 10.30 a.m. (i.e.,) first working day of every month, until further orders. Accordingly, both petitions are allowed.
