PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondent Nos.1 to 6 to take action against the 7th and 8th respondents for conducting religious activity, in residential area in S.F.No.77/3A3A, Plot No.27 situated at Bharathi Nagar, Pudukkottai Main Road, Gundur, Trichy District, without approval from the appropriate authority, based on the petitioner's representation, dated 18.03.2024. ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents 1 to 6 to take action against the 7th and 8th respondents for conducting religious activity, in residential area in S.F.No. 77/3A3A, Plot No.27 situated at Bharathi Nagar, Pudukkottai Main Road, Gundur, Trichy District, without approval from the appropriate authority, based on the petitioner's representation dated 18.03.2024. 2.The 8th respondent has filed an affidavit stating that the building is being run in the name of Maanavar Padipagam "khzth; gbg;gfk;" and no 2/6

religious activities are conducted.

3.The learned Special Government Pleader appearing for respondents 1 to 4 and the learned Additional Government Pleader appearing for respondents 5 and 6 submitted that the respondents 7 and 8 are running an Association namely, "Tamil Nadu Muslim Munnetra Kazhagam, Manithaneya Makkal Katchi", and is also conducting prayers "njhOif". Therefore, it is confirmed that the allegation stated in the writ petition is true. 4.The learned Counsel appearing for the petitioner vehemently submitted that until today, ie., 18.06.2025, they are conducting prayers and he also showed videos. The authorities also confirmed the same. 5.Therefore, the respondents 7 and 8 or any person through the respondents are restrained from conducting any prayers in the disputed premises. The respondents 1 and 3 to 6 are directed to ensure that no such prayer meeting is conducted in the disputed premises.

6.Further, the allegation by the petitioner is that the respondents 7 and 8 have not taken any planning permission from the appropriate authority. The 2nd respondent is directed to take action as per law, if the allegation is true. 3/6

7.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
