Respondents PRAYER :- This Petition is filed under Section 528 BNSS, to call for the records pertaining to the impugned FIR in Crime No. 43 of 2025 on the file of the first respondent police and quash the same. For Petitioners : Mr.Naresh Prabu A, For Respondents : Mr.K.Sanjai Gandhi, Government Advocate (Crl.Side) for R1 : Mr.Mariselvam for R2 COMMON ORDER These Criminal Original Petitions are filed to quash the impugned F.I.Rs in Crime No.42 of 2025 for the offences under Sections 3(5), 296(b), 118(1), 351 (3) 303 (2) BNS, and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002; and in Crime No.43 of 2025 registered for the offences under Sections 3(5), 296(b), 126(2), 118(1) and 351 (3) BNS.
2. The accused in one case is the defacto complainant in the other case. The allegations in both the cases which were registered as case and case in counter are that due to a quarrel, in a temple festival, the 3/6
petitioners in each of the cases attacked the defacto complainant and others with sticks and hands, abused them in filthy language and committed the offence of criminal intimidation.
3. The learned counsels for the petitioners in both the cases would submit that due to the intervention of the elders, the parties have now arrived at a compromise and decided to give a quietus to the entire dispute. The parties have filed joint compromise memos dated 08.07.2025 and 17.07.2025.
4. The petitioners and the defacto complainant in both the cases and the victim in Crl.O.P.(MD)No.11602 of 2025 are present before this Court in person. They are identified by Mr.D.Sekar, SSI, Thattaparai Police Station, Thoothukudi District. All the parties confirmed the compromise arrived at between them.
5. Considering the nature of allegations, the relationship and the compromise arrived between the parties, this Court is of the view that no useful purpose would be served in keeping the impugned FIRs pending 4/6
investigation. Accordingly, the impugned F.I.Rs are quashed and the Criminal Original Petitions are allowed. The joint compromise memos dated 08.07.2025 and 17.07.2025 shall form part and parcel of this order. The petitioners shall pay a sum of Rs.10,000/- (Rupees Ten Thousand only) in each case as costs to the Mediation and Conciliation Centre attached to this Bench and file a photocopy of the receipt along with a memo reporting compliance in the Registry. Consequently, connected Miscellaneous Petitions are closed.
