For Respondent : Mr.B.Nambiselvan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.72 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- 1/4

The petitioner/4th accused, who apprehends arrest at the hands of the respondent Police for the alleged offences punishable under Sections 6(4) of TNSC (RDCS) Order, 1982 r/w. Section 7(1)(a)(ii) of Essential Commodities Act, 1955, in Crime No.72 of 2023 on the file of the respondent Police, seeks anticipatory bail. 2.The case of the prosecution that the accused persons were found in illegal transportation of 1500 kgs of PDS rice through vehicle bearing Registration No.TN 38 CM 1208. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution. Due to statistical purpose, false complaint has been registered against the petitioner.

4. The learned Additional Public Prosecutor would submit that the petitioner is a habitual offender of similar offences. Even though he was acquittal in Crime No.09 of 2013, he was convicted in Crime Nos.48 of 2014 and 336 of 2022, another case in Crime No.18 of 2022 is pending trial and a History Sheet is maintained against the petitioner in H.S.No.22 of 2014.

5.Considering the facts and circumstances of the case and also considering the bad antecedent of this petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
