Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the Impugned order of Cancellation in online in respect of the Electricity Application reference No.200053020625464 dated 03.06.2025 and consequently direct the respondent to provide Electricity Connection to the petitioner's house constructed on the land in Survey No.335/294PT, Door No. 55-A, situated at Raja Aranmanai West Street, Ramanathapuram Taluk, Ramanathapuram District, in accordance with law, within the time stipulated by this Court.

ORDER

This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and the learned counsel for the respondents. The petitioner appears to have made an application on 03.06.2025 for a fresh 2/7

electicity connection. According to the petitioner, the land measuring to an extent of 2.74 Acres in RRS No.335/394, which was purchased by the petitioner's grand father namely on Krishnasamy Thevar vide document No. 11/76 dated 25.06.1976 and converted thes ame into plots. Later, in respect of plot No.10, settlement deed was executed in favour of the petitioner's father namely Ramasamy Thevar by a registered document No.370 of 1979 dated 03.03.1979, which is now in Survey No.335/294PT situated in Raja aranmanai West Street, Ramanathapuram.

2. It is submitted that the land originally belongs to Krishnasamy Thevar and there are several disputes pending between the petitioner and his sister regarding the aforesaid land. Presently, this Court is seized of the matter in S.A(MD) No.419 of 2007.

3.It is further submitted that the petitioner and his sister jointly constructed a house on the aforesaid property ten years ago and had been sharing the electricity connection. However, due to difference of opinion arose between them, the petitioner's sister has refused to give power supply to the portion occupied by the petitioner. As a result, the petitioner is currently 3/7

residing without electricity and has executed an indemnity bond in this regard .

4. On the other hand, the learned counsel for the respondents would submit that the petitioner has not produced any documents to substantiate that he is the owner of the aforesaid property. Hence, it is not possible to provide a new electricity connection to his portion of the house.

5. After hearing the learned counsel for the petitioner and the learned counsel for the respondent, this Court is inclined to direct the fourth respondent to consider the request of the petitioner, dated 03.06.2025 for providing the electricity connection after conducting a site inspection.

6. If it is found to be feasible, the fourth respondent shall take appropriate steps to provide a separate electricity connection to the petitioner. The petitioner's sister may also be advised to co-operate, in order to avoid any practical difficulties in effecting the connection.

7. If it is not feasible to give a new electricity connection without prejudice to the rights of the parties in S.A.(MD) No.419 of 2007, the fourth 4/7

respondent shall consider the request of the petitioner, dated 03.06.2025 within a period of four weeks from the date of receipt of copy of this order.

8. With the above direction, this Writ Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. No costs. 08.07.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No Indu 5/7
