Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of mandamus directing the fourth respondent to permit the petitioner to work as the supervisor as per the order dated 25.07.2019 and consequently to consider the petitioner representation dated 07.08.2019.

ORDER

This petition is filed, directing the Commissioner of Madurai Corporation to permit to the petitioner to work as the supervisor, as per the order dated 25.07.2019 and consequently to consider the petitioner's representation dated 07.08.2019.

2. It is the case of the writ petitioner that the petitioner was working as scavenger with the fourth respondent corporation for nearly about 12 years and she has completed tenth standard. She had made a request before the fourth respondent on 12.02.2018, 24.05.2018 and 26.06.2019 and also sent a representation to consider her request to the post of Supervisor.

2(ii). While considering the request the fourth respondent therein has passed an order on 25.07.2019 and granted the post of Supervisor for posting at West Division I, Ward No.1. Her name was also included as Sl.No.3, in the list published on 25.07.2019. The fourth respondent vide order dated 25.07.2019, the other similar persons were permitted to join as supervisor in their respective places but she was denied to join the said post. Hence this petition.

3. The learned counsel appearing for the fourth respondent/corporation has no serious objection to issue direction to the fourth respondent to consider the representation submitted by the writ petitioner.

4. It is seen from the type set of papers of the fourth respondent/ corporation, has passed an order dated 25.07.2019 some of the similarly persons were permitted to join as supervisor in their respective places.

5. The petitioner has also annexed representation submitted to the respondents along with postal acknowledgement receipts in the type set of papers. Without going to the merits of the case, this Court is inclined to direct the fourth respondent to consider the representation dated 07.08.2019 and pass orders on merits and in accordance with law, if there

is no legal impediment.

6. With the above directions this writ petition is disposed off. No costs.
