For Respondent : Mr.S.MANIKANDAN, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Bail in Crime No.163 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioners/accused who apprehends arrest at the hands of the respondent police for the offence punishable under sections 4(1)(aaa) of Tamil Nadu Prohibition Act in Crime No.163 of 2023, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 26.05.2023, the petitioners are having 1/3

huge quantity of liquor bottles. Hence, the case. 3.Objection has been raised by the learned Additional Public Prosecutor stating that huge quantity of foreign made liquor bottles recovered from a shop in the complex. All the accused persons were present in the above said shop. On seeing the police party, they fled away from that place. Recovery mahazar has been prepared. It is further submitted that the petitioners moved Crl.M.P.No.2599 of 2023, before the Principal District Judge, Dindigul. Considering the huge quantity of liquor bottles, the above said petition was dismissed by the order dated 12.07.2023. Even though the petitioners are not having similar cases, considering the fact that huge quantity of liquor bottles have been recovered from the above said spot, this court is not inclined to grant anticipatory bail to the petitioners. 4.Let the petitioners surrender before the respondent police and co-operate with them to find out the source from where the above said liquor has been purchased. 5.With the above said directions, this criminal original petition stands dismissed.
