PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to call for the records pertaining to the First Information Report in Crime No. 259 of 2022 on the file of the first respondent and quash the same.

O R D E R

This Criminal Original Petition has been filed to quash the proceedings in Crime No. 259 of 2022 on the file of the first respondent police.

2. The learned Counsel for the Petitioner would submit that Petitioner and the second Respondent are neighbours. The offences alleged in the First Information Report are 294(b),324,427 and 506(ii) of IPC. After registration of the First Information Report, the matter was amicably settled between the parties, therefore the petitioners seeks quash the First Information Report.

3. The learned Additional Public Prosecutor vehemently objected to the line of the arguments of the learned counsel for the Petitioners stating that the date of occurrence is 31.07.2022 and the First Information Report came to be registered on 02.08.2022. He further submitted that the petitioners herein trespassed into house of the defacto complainant and damaged the door of the defacto complainant worth about Rs.5000/- 2/5

This Court had raised query with the learned Counsel for the Petitioner, whether the Petitioners are ready to pay a sum of Rs.50000/- towards compromise to the defacto complainant, for which he is unable to give reply. The learned Counsel for the second Respondent/Defacto Complainant would submit that the Petitioners are the grand sons of the defacto complainant.

5. Since the learned counsel for the Petitioner is unable to give reply to the query raised by this Court, this Court is not inclined to quash the proceedings in Crime No. 259 of 2022 on the file of the first respondent police.
